When Does a Case Become a Class Action?

Class action lawsuits allow people who have been harmed in the same way by the same company, employer, or institution to band together in a single case. When Does a Case Become a Class Action?

Not every case can proceed as a class action. As stated by the Federal Rule of Civil Procedure 23(a), a case must first meet four prerequisite requirements. The criteria are:

  • Commonality: The group shares the same legal claims and factual background.
  • Typicality: The claims of the representative plaintiffs are typical of the entire class.
  • Adequacy: The named plaintiffs and their attorneys will fairly represent the interests of the class.

If these requirements are met, the court may certify the class, allowing the case to move forward on behalf of everyone involved.
