Partners Matthew A. Luber, Esq. and Kelly E. Adler, Esq. represent nurse alleging she was terminated in retaliation for reporting chronic understaffing at a New Jersey Nursing Home. As alleged in the complaint, Plaintiff Mary Zazzarino was often the only nurse on duty and had to care for approximately 115 residents herself. When she spoke up against this egregious understaffing, she was punished and eventually fired. The lawsuit, filed in Superior Court of Middlesex County, alleges Brighton Gardens and Sunrise Senior Living violated state employment and disability laws, whistleblower laws, discriminated against Zazzarino due to her age, retaliated against her for complaining and wrongfully terminated her.
“As alleged in the complaint, Sunrise Senior Living was horrifically ill-equipped to care for its residents on a daily basis, let alone during a flu outbreak or pandemic. Ms. Zazzarino was often the only nurse on duty and had to care for approximately 115 residents herself. When she spoke up against this egregious understaffing, she was punished and retaliated against in violation of the law. In the end, her career was destroyed because Sunrise Senior Living cares more about its profits than its residents and employees.” Matthew A. Luber, Esq., McOmber McOmber & Luber, P.C.
