Matthew Luber, Esquire of McOmber McOmber & Luber, P.C. represents Joseph Fusco, who was allegedly assaulted by his Uber driver in Philadelphia on December 22, 2016. A complaint against Uber was filed on Mr. Fusco’s behalf in the United States District Court for the Eastern District of Pennsylvania on January 4, 2016. As alleged in the complaint, at approximately 11:00 p.m., Mr. Fusco left a company Christmas party in Center City Philadelphia and requested an Uber to his home in Cherry Hill, New Jersey. Upon entering the Uber vehicle, the unidentified Uber driver learned of Mr. Fusco’s destination and refused to drive him to New Jersey. Mr. Fusco, who is married and father to a newborn, had no other way to get home safely and repeatedly asked the Uber driver take him to his destination.
As alleged in the complaint, the Uber driver then exited the car and dragged Mr. Fusco out of the front passenger seat of the car by his neck. The Uber driver then brutally beat Mr. Fusco to a state of unconsciousness and, while Mr. Fusco partially lay in the Philadelphia street, the Uber driver continued to stomp on Mr. Fusco’s head. As a result of the vicious attack, Mr. Fusco suffered multiple broken bones in his face, severe lacerations on his cheeks and forehead, and lost several teeth. The Uber driver immediately fled the scene and, to add insult to injury, proceeded to charge Mr. Fusco for a fake ride across Philadelphia that was never given.
The complaint seeks damages against Uber for negligent hiring, negligent supervision, negligent retention, fraud, negligent misrepresentation/non-disclosure, consumer fraud, battery, assault, and intentional infliction of emotional distress.
