Fox News host Gretchen Carlson and other female reporters recently sued Fox News chief Roger Ailes for sexual harassment, a case which has received a great deal of publicity and resulted in a large settlement for Carlson. Unfortunately, people in positions of power, like Ailes, continue to make offensive comments or engage in inappropriate physical advances, because they continue to get away with it. At McOmber McOmber & Luber, P.C., we believe that such behavior should not go unpunished.
In response to the allegations against Ailes, Geraldo Rivera came to his defense, saying he never personally saw any signs of sexual harassment. Men are far less likely to be sexually harassed, and people tend to be shaped by their own personal experiences. Therefore, Rivera believed that Ailes was innocent. However, just because Rivera did not see Ailes engage in inappropriate sexual behavior towards Gretchen Carlson does not mean that it did not happen.
This way of thinking can affect how we measure public policy because it can influence whose account we believe. If you have never seen or experienced sexual harassment, you may question someone who says that it happens on a regular basis. Unfortunately, in matters involving sexual harassment, when a victim comes forward, oftentimes the abuser will use their power to suggest that they were the one being harassed. This creates a he-said-she said mentality, rather than focusing on the issue of victim versus abuser.
Clearly, we have come a long in the past 50 years, but there is still a long way to go in terms of changing attitudes and shifting behavior. Sadly, many individuals continue to face sexually harassing behaviors in the workface despite advances that have been made in modern society.
