Changes to NJ Family Leave Laws
New Jersey sees a new pair of laws that will change family leave for expecting families. This new pair of laws speeds up and eases the process of collecting cash from the state’s temporary disability. In effect, these laws cut down the wait time for families to receive money for disability or an expecting child. New Jersey’s Department of Labor and Workforce Development processes applications for New Jersey workers who take leave for either a disability or a new baby. These laws change the way the state processes these applications.
The state’s family leave insurance pays workers a share of their lost wages while caring for newborns, while temporary disability insurance provides short-term disability for someone unable to work due to an injury.
Newly Implemented Law
The new state law streamlines the process for those who apply for pregnancy-related temporary disability benefits and family leave benefits. After the worker applies for temporary disability benefits to take care of a newborn, the state is now required to automatically process an application for family leave insurance for that individual. This alleviates the worker from filling out additional applications. Under NJ state law, expectant mothers are eligible for up to 4 weeks of temporary disability benefits prior to the baby’s delivery. After they deliver, expectant mothers are eligible for up to 6 weeks of family leave benefits, or 8 weeks if she undergoes a c-section.
Further, the second law passed potentially helps workers collect benefits sooner. If the individual worker knows when she expects to begin her leave from work, this law allows workers to claim pregnancy-related temporary disability insurance and family leave insurance up to 60 days before the claim period.
