Luber Represents Passenger Abandoned by Uber Driver in Fort Washington

Matthew A. Luber, Esquire of McOmber McOmber & Luber, P.C. represents Carla Guzman, who was left on a Pennsylvania Turnpike Exit Ramp by an allegedly impaired Uber driver. A complaint against Uber was filed on Mrs. Guzman’s behalf in the Court of Common Pleas of Philadelphia County, Pennsylvania on January 15, 2018. As alleged in the complaint, Mrs. Guzman scheduled an Uber to take her to the Philadelphia International Airport. Upon entering the Uber vehicle, Mrs. Guzman noticed that the Uber driver looked disheveled and the car was a mess. As the ride progressed, Mrs. Guzman became concerned the Uber driver was intoxicated or impaired as her pronunciation was not clear, eyes were bloodshot, and she seemed disoriented.
As alleged in the complaint, Mrs. Guzman noticed that the driver’s GPS was taking a longer route, and she suggested they take the faster toll route. Mrs. Guzman’s polite request oddly upset the Uber driver. As they approached the Pennsylvania Turnpike, the Uber driver then became enraged, screaming in a belligerent manner that she did not have EZ-Pass. Mrs. Guzman paid the $41.05 toll and fine after the Uber driver threatened to kick Mrs. Guzman out of the vehicle. Immediately after leaving the toll booth, the Uber driver told Mrs. Guzman that she was cancelling the ride and dropping her off. The Uber driver then started driving toward the on-ramp to PA Route 309, which was in the opposite direction of PHL. Mrs. Guzman told the driver that “the next exit is 20 minutes away” and the Uber driver abruptly stopped the vehicle and demanded Mrs. Guzman “get out”. Mrs. Guzman was left on the dark and dangerous Pennsylvania Turnpike Exit Ramp. Mrs. Guzman then scrambled a quarter-mile, with her luggage, alongside the exit ramp, jumped a six-foot fence, and called a taxi at the nearby Best Western.

The complaint seeks damages against Uber for negligent hiring, negligent supervision, negligent retention, fraud, negligent misrepresentation/non-disclosure, consumer fraud, and intentional infliction of emotional distress.
