On May 14, 2024, a trial team of Matthew A. Luber, Esq., R. Armen McOmber, Esq., Meghan A. Pazmino, Esq., and Jaclyn E. Alston, Esq. from the law firm of McOmber McOmber & Luber, P.C. secured a $100,000 Verdict.
The lawsuit was originally filed over six years ago in Camden County Superior Court on behalf of a former manager at McRech, Inc. d/b/a Turnersville Chrysler Jeep Dodge & Ram. Our client claimed she was subjected to a sexually hostile and retaliatory working environment by the General Sales Manager, which resulted in her unlawful discharge from the dealership in September 2017. Following a four-day bench trial, the Honorable Donald J. Stein concluded, among other things, that our client was subjected to sexual discrimination, harassment, and retaliation after, among other things, she was touched on the breast by the General Sales Manager. Judge Stein also concluded that, once the dealership became aware of the harassment, it failed to take corrective/remedial action in violation of the New Jersey Law Against Discrimination (“NJLAD”). Judge Stein awarded our client all of her requested back-pay damages of approximately $25,000 and an additional $75,000 in emotional distress damages. The client’s lawyers now anticipate applying to recover all of her attorneys’ fees, costs, and delay damages, as is permitted by the NJLAD.
“After six years of litigation, the Court concluded that the dealership completely failed to protect our client from egregious discrimination, harassment, and retaliation in the workplace. We are so proud of our client for standing up for herself, for civil rights, for women, and, in particular, for having the courage and fortitude to hold those responsible accountable. The Judge sent a clear message to employers that such conduct will not be tolerated.” Matthew A. Luber, Esq., McOmber McOmber & Luber, P.C.
