Partner Charles J. Kocher, Tyler J. Burrell, and Gaetano J. DiPersia secured a $4.6 million class-action settlement for over 13,000 Target New Jersey warehouse workers employed since August 6, 2019. In the lawsuit, the Plaintiffs allege that Target has a uniform policy of not paying its hourly warehouse employees for all hours worked and that Target did not compensate them for pre-shift time required to travel to their assigned departments to clock in. Plaintiffs also allege that Target stopped paying Plaintiffs once they clocked out, even though it required them to perform work by walking on certain designated pathways to undergo security screening measures, badge out (again), and exit the main entrance so it could watch them on the way out. Therefore, we contend that Plaintiff and the Class members were not paid all hours worked under New Jersey law. Target denies Plaintiff’s allegations. However, after good-faith negotiations and with the assistance of the Court, the Parties agreed to settle the Action. The settlement was preliminarily approved by the Court on October 30, 2025.
This significant settlement comes after the Court certified a litigated Rule 23(b)(3) class in January 2025.
