The complaint was filed on March 15, 2019 in the Salem County Superior Court of New Jersey and includes allegations of sexual harassment, discrimination, and retaliation.
The plaintiff, a 27-year-old woman, works as a residential manager for the company. She claims that she faced sexual harassment from her boss who made multiple crude comments to her and sent her lewd text messages as well as propositioned her several times. He also reportedly left sexual aids on her desk, sent her unsolicited photos of his genitals, and exposed himself to her.
After reporting her boss’s egregious and wrongful behavior to the human resources supervisor, our client claims no action was taken and her claims were dismissed as being humorous. Her boss allegedly requested that she not share the details of the incident to her spouse and suggested that she drop the complaints altogether. It is also alleged that the company failed to investigate the situation further or take any corrective action against the alleged harasser.
Our client not only endured sexual harassment, she also feared retaliation if she further pursued action against her employer and others who supported him. Once the complaints were discussed by the plaintiff and the defendants at a meeting, her colleague with whom she shared office space became openly hostile and ignored her when she asked him work-related questions.
Claims of Pay Inequality
Our client was first hired in 2016 as a receptionist and was promoted to a residential manager position in 2018. The claim also alleges wage discrimination. It is reported that the female employee was not offered the same salary, benefits, or bonuses as male employees in comparable positions within the company.
Due to the emotional distress she faced on a daily basis, our client suffered from anxiety and panic attacks. She eventually visited her doctor who granted her a medical leave from her job before filing suit.
