What are the Wage & Hour Laws in NJ?

New Jersey’s wage and hour laws are designed to protect employees’ rights and guarantee fair treatment in the workplace. These laws cover essential topics such as minimum wage, overtime pay, paid sick leave, and protections against wage discrimination.

General Wage and Hour Laws

  • Fair Labor Standards Act: A federal law that sets minimum wage, overtime pay eligibility, recordkeeping, and child labor standards. It requires that workers earn at least the federal minimum wage and time-and-a-half for hours worked over 40 in a week.
  • NJ State Wage and Hour Law: New Jersey’s law establishing the state minimum wage, overtime rules, and regulations for meal breaks and recordkeeping. It provides additional protections beyond federal laws, such as a higher minimum wage.
  • NJ Earned Sick Leave Law: Requires employers to provide up to 40 hours of paid sick leave annually. Employees can use this time for personal illness, care for a sick family member, or address domestic violence issues.

Equal Pay and Anti-Discrimination Laws

  • Diane B. Allen Equal Pay Act: A New Jersey law mandating equal pay for equal work, regardless of gender, race, or other protected characteristics. It strengthens penalties for wage discrimination and applies to all employees doing substantially similar work.
  • NJLAD (New Jersey Law Against Discrimination): Prohibits discrimination in employment based on protected categories such as race, gender, disability, or age. It includes provisions that promote equal pay and prevent wage disparities tied to discrimination.
  • ADEA (Age Discrimination in Employment Act): A federal law protecting workers aged 40 and older from wage discrimination. This gives older employees fair and equal compensation when performing the same roles as younger employees.
  • ADA (Americans with Disabilities Act): A federal law requiring equal pay and workplace accommodations for employees with disabilities. It prohibits wage discrimination based on disability status when workers perform equal work.
