Partners Christian V. McOmber and Peter D. Valenzano represent Nadia Zevallos in a whistleblower retaliation claim filed against Garden State Dental in Union, New Jersey. The complaint alleges that Ms. Zevallos was subject to disparate treatment and retaliation, after objecting to widespread alcohol and drug abuse in the workplace. In retaliation for objecting to the danger this substance abuse posed to patients and staff, and as a result of Defendant Garden State Dentals failure to maintain a safe work environment free from harassment and retaliation, the Plaintiff was constructively terminated from her employment.
The lawsuit, which was filed in Union County Superior Court, alleges violations of, among other things, the Conscientious Employee Protection Act. Ms. Zevallos seeks compensatory damages, punitive damages, and attorneys’ fees and costs.
