Mr. McOmber is a third generation attorney and a lifelong resident of Monmouth County. His primary practice areas are alternate dispute resolution, business law, civil litigation, debt collections, employment law, and personal injury. Mr. McOmber’s experience in executive business management provides his commercial clientele with valuable insight. He provides general corporate representation to a wide range of industries including distributors, general contractors, manufacturers, and service providers. Mr. McOmber focuses on providing businesses with responsive service, strategic insight, and practical solutions. His commercial clientele includes Central Metal Fabricators, Inc., a firm that designs and manufactures precision components for the United States Department of Defense, RoomService Amenities, a leading national supplier of guest room products, and a number of SERVPRO franchises.
As a member of the National Employment Lawyers Association, Mr. McOmber believes that all workplaces should be free of discrimination, sexual harassment, wrongful discharge, and other such violations. To that end, Mr. McOmber has extensive experience litigating employment matters on behalf of both employees and employers. He has successfully litigated matters involving a diverse range of employment disputes such as racial discrimination, sexual harassment, sexual orientation discrimination, hostile workplace environment claims, restrictive covenants, and wage and hour claims. As counsel to employees, Mr. McOmber has obtained a number of significant and noteworthy victories including a jury verdict in excess of one million dollars for the victim of sexual orientation discrimination. As counsel to employers, he works with his clients to prevent possible claims by ensuring statutory and regulatory compliance. Mr. McOmber regularly implements employment policies, trains staff, conducts investigations related to employee complaints, and defends employment claims. He regularly negotiates employment and severance agreements and has experience negotiating multi-million dollar compensation packages on behalf of executives.
Mr. McOmber is a highly skilled collections attorney who has collected millions of dollars on behalf of his clients. Where other attorneys fall short, Mr. McOmber has extensive experience with asset investigations, post-judgment execution proceedings, and asset seizure. He vigorously pursues significant collection matters throughout New Jersey and the United States on behalf of such companies as Jones Lang LaSalle Americas, Inc. On account of his expertise with commercial collections, Mr. McOmber was appointed by the United States Bankruptcy Court as special counsel to a national firm involved in Chapter 11 reorganization and oversaw extensive litigation throughout the continental United States and Alaska.
Mr. McOmber has extensive experience litigating high value personal injury claims including slip and fall accidents, assaults, and other accidents involving negligence. He tenaciously pursues personal injury claims by conducting prompt and thorough investigations, invoking the highest caliber of liability and medical expertise, and dedicating focused attention to each matter.
Mr. McOmber also has experience litigating and mediating a wide range of other disputes including real estate matters, will contests, and construction matters. Mr. McOmber is admitted to the roster of New Jersey State Court-Approved Mediators as a R. 1:40 Qualified Mediator. His experience as both a litigator and mediator provides him with practical and strategic insight.
Mr. McOmber earned a Bachelor of Science Degree from Cornell University’s College of Architecture, Art, and Planning where he majored in City and Regional Planning. Following graduation, Mr. McOmber served as the general manager of Mardem Manufacturing Company, A Division of Seton Associates, Inc. (“Mardem”). Mardem manufactures turnkey filling and packaging systems for companies such as Benjamin Moore & Co., The Sherwin Williams Co., RPM International, Inc., The Sun Chemical Group, Castrol Industrial, and Total Lubricants. Following Mr. McOmber’s successful reorganization of Mardem, he was promoted to president and acquired an equity interest in the company. In 2006, he sold Mardem to a competing firm and pursued his life-long aspiration to become an attorney with McOmber McOmber & Luber, P.C.
Mr. McOmber earned a Juris Doctor degree, Magna Cum Laude, from Seton Hall University School of Law in Newark, New Jersey. He graduated 9th in his class of 318 students and attained a final grade point average of 4.0. At Seton Hall, Mr. McOmber was awarded the 2010 Commercial Law League of America‘s Excellence in Commercial Law Award. Mr. McOmber was also inducted into the Order of the Coif, a national legal honor society.
As a law student, Mr. McOmber participated in an Advanced Arbitration Clinic and successfully arbitrated a number of cases before the New Jersey Division of Consumer Affairs, Alternative Dispute Resolution Unit (“DCA”). Based on his arbitration advocacy, he was invited to serve as a volunteer arbitrator for the DCA, where he currently arbitrates three to four cases per month.
In 2010, Mr. McOmber was admitted to the New Jersey and Federal District Court Bars and joined the firm of McOmber McOmber & Luber, P.C., which was established in 1974 by his parents, Richard and Adrienne McOmber. He lives in Middletown, NJ and has three children. Mr. McOmber is an avid boater and a member of the Shrewsbury River Yacht Club, for which Mr. McOmber also serves as general counsel. In 2013, Mr. McOmber received the Shrewsbury River Yacht Club’s Commodore’s Award for his legal service to the club following Hurricane Sandy.
