Can My Employer Fire Me While I’m Pregnant?

August 7, 2025 by Red Bank Legal

Pregnant women in New Jersey often face discrimination or wrongful termination while expecting. From our offices in Red Bank, Marlton, and Newark, McOmber McOmber & Luber, P.C., represents employees who have faced discrimination due to their pregnancy. If you’re worried about being fired while pregnant, understanding your legal protections is the first step toward standing up for your rights.

Can My Employer Fire Me While I’m Pregnant?

While employers can terminate employees for valid reasons, it is illegal to fire someone simply because they are pregnant. Under both New Jersey and federal law, pregnancy is a protected characteristic. If your pregnancy influenced your employer’s decision to fire (or hire) you, this may qualify as discrimination.

Employers may try to mask discrimination by claiming performance issues or restructuring, but the timing and circumstances often reveal the truth. If you were let go shortly after disclosing your pregnancy or requesting leave, speak with an attorney.

Do Discrimination Laws Apply to Pregnancy?

Yes. Pregnancy is explicitly covered under the New Jersey Law Against Discrimination and the federal Pregnancy Discrimination Act. These laws require employers to treat pregnant workers the same as others with temporary medical conditions. Discriminating against someone for being pregnant, planning to become pregnant, or taking maternity leave is unlawful in New Jersey.

Understanding Your Rights While Pregnant

Pregnancy should not put your job, income, or future at risk. Fortunately, both state and federal laws give pregnant employees several protections in the workplace. Knowing these rights can help you spot unlawful treatment and take appropriate action before the situation gets worse.

  • You have the right to request reasonable accommodations for pregnancy-related medical needs.
  • You cannot be fired, demoted, or denied opportunities due to your pregnancy.
  • You may be eligible for job-protected leave under the Family and Medical Leave Act.
  • New Jersey’s Family Leave Act allows time off to bond with your child.
  • You are entitled to return to the same or a similar role after taking leave.

If you believe your employer has ignored or violated any of these rights, do not wait to seek help. These laws exist to protect you during one of the most important times in your life, and legal action may be necessary to ensure your rights are upheld and your job is secure.
